A Generally Binding Agreement is in place for paper and cardboard.
This means that the private agreement between the Producers Responsibility Organisation in question and the affiliated producers is declared generally binding to all producers of the product group. Even to producers that did not support the agreement or the request for the Generally Binding Agreement in the first place. As a result, all producers are bound by the agreement, imposing an obligation on everyone to pay for the EPR system. This creates a level playing field.
You should register at the producers responsibility organisation for paper and cardboard, called Papier Recycling Nederland (PRN).
If you receive paper and cardboard for the first time in a professional capacity on the Dutch market, and these are not packaging, you are considered a 'producer' and must comply with the EPR obligations. The producer organization Papier Recycling Nederland (PRN) uses the term 'first receiver' instead of producer.
A producer (first receiver) is the one who, in a professional capacity, first receives paper or cardboard in the Netherlands with the intent to offer it, processed or unprocessed, to another party on the Dutch market.
However, you are also producer (first receiver) in case you:
The obligations only apply to producers of paper and cardboard products for applications other than packaging.
A paper and cardboard product is:
"A product in which the weight component of cardboard or paper is the heaviest material. This refers to paper and cardboard that has not yet been processed, or ready-made products."
The obligations therefore do not apply to producers of other paper and cardboard, for instance products not containing paper and cardboard as heaviest material component. Or products used for packaging applications.
